Terms of Service

1. Acceptance of Terms
By accessing or using the ElevatedIQ platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.
2. Service Description
ElevatedIQ provides an enterprise multi-cloud governance platform including:
- Cloud resource discovery, inventory, and compliance scanning
- Cost optimization and FinOps analytics
- AI-powered incident response and remediation
- Security posture management across AWS, Azure, and GCP
- Managed SOC, SIEM, and threat intelligence services
3. Account Registration
You must provide accurate, current, and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any component of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to transmit malware, spam, or malicious content
- Resell, sublicense, or provide the Service to third parties without our written consent
5. Intellectual Property
The Service, including all software, documentation, designs, and trademarks, is owned by ElevatedIQ and protected by intellectual property laws. Your subscription grants a limited, non-exclusive, non-transferable license to use the Service during the subscription term.
Your data is yours. We claim no ownership of the data you provide. You grant us only the limited rights necessary to provide the Service.
6. Fees and Payment
- Fees are as stated in your order or on our pricing page at the time of purchase
- Subscriptions renew automatically unless canceled at least 30 days before the renewal date
- Payments are non-refundable except as required by law or as specified in your enterprise agreement
- We may adjust pricing with 60 days' written notice before your next renewal
7. Service Level Agreement
ElevatedIQ provides a 99.9% uptime SLA for production platform services, measured monthly. If we fail to meet this commitment, affected customers may request service credits as described in the SLA addendum provided with your enterprise agreement.
8. Data Protection
Our processing of your data is governed by our Privacy Policy and, where applicable, a Data Processing Agreement (DPA). We maintain SOC 2 Type II, FedRAMP Ready, and HIPAA-compliant controls.
9. Limitation of Liability
To the maximum extent permitted by law, ElevatedIQ's total liability under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.
10. Indemnification
You agree to indemnify and hold harmless ElevatedIQ from claims arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
- Either party may terminate these Terms with 30 days' written notice
- We may suspend or terminate your access immediately for material breach or violation of the Acceptable Use policy
- Upon termination, you may export your data within 30 days; after that period, we may delete it
12. Modifications
We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or an in-product notice. Continued use after the effective date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
